From the initial investigatory phase, through the completion of the case, everyone has constitutional rights that need to be protected. The best way to ensure that your rights are protected is to consult an attorney. As soon as you become suspected of a crime, you should speak to absolutely no one about the facts of the case, but a criminal defense attorney. Neither you nor your attorney can be forced to testify against you. Practically everyone else can be subpoenaed into court to testify against you. If the time ever comes for you to talk to the police and/or the prosecutor, that time should be selected by you and your attorney.There are two types of criminal charges:
- Felony - Any crime in which a sentence of death or to a term of imprisonment in a penitentiary for one year or more is provided.
- Misdemeanor - Any crime in which a sentence to a term of imprisonment in other than a penitentiary, for less than one year, may be imposed. Any offense for which the maximum punishment available is 364 days in jail, is a Misdemeanor.
